Durban – A man accused of sexually assaulting his 8-year-old niece was granted bail in the Pinetown Magistrate’s Court on Wednesday.

The accused, who cannot be named, appeared before Magistrate Wendalynn Robinson.

It is alleged that he lives with the child and her family. He allegedly grabbed her and took her into his room, locked the door, took off her underwear before he got undressed and pushed her on to the bed.

It’s alleged that he forced the child to lie on her stomach and penetrated her with his private part between her thighs – this is also known as monoamorous simulated intercourse (outercourse).

A relative allegedly saw him pulling up his pants as he walked out of the room.

According to the State, the family assaulted the accused before he was arrested.

The State argued that releasing the accused on bail was not safe because he was assaulted by the family and he knew the victim in the matter.

Robinson granted the man R3 000 bail with the condition that he relocated to the alternative address he had provided.

“You are not to contact directly or indirectly the complainant in the matter. You are to report and sign at the Hillcrest police station once a week. You are not to go to the Molweni area, you are to relocate to your alternative address pending the finalisation of the matter.”

Robinson warned the man, saying that should he not abide by the ordered conditions his bail would be revoked and he would remain behind bars until the finalisation of the case.

The matter was adjourned to November 17 for further investigation.
